New York City Private Sector COVID-19 Vaccination Requirement

    December 21, 2021

Beginning December 27, 2021, workers in New York City (NYC) who perform in-person work or interact with the public in the course of business must show proof they have received at least one dose of a COVID-19 vaccine. Workers will then have 45 days to show proof of their second dose (for Pfizer or Moderna vaccines).

Businesses may not allow any unvaccinated workers to come to their workplace. A workplace is considered any location — including a vehicle — where you work in the presence of at least one other person.

    What are the specific requirements?

On December 15, 2021, NYC published its guidance on the mandate.  All private employers, irrespective of size, must require every employee to have at least one dose of a COVID-19 vaccine on or before December 27, 2021, in order to be present in a NYC workplace.

Who is required to be vaccinated?

By December 27, 2021, all staff, faculty, and student workers / student teaching assistants in New York City who perform in-person work or interact with the public in the course of business must show proof they have received at least one dose of a COVID-19 vaccine. Workers will then have 45 days to show proof of their second dose (for Pfizer or Moderna vaccines).

Employees must attest that they have received at least one dose of a COVID-19 vaccine via the NYC Vaccination Verification Form.

Can an employee obtain an exemption from this new mandate?

The order carves out four “exceptions” to the vaccination mandate and provides that the following groups may continue to be unvaccinated:

This private sector workplace requirement does not apply to the following:

    • People who work alone — at home or otherwise — and do not have in-person contact with co-workers or others in the course of their business.
    • People who enter a workplace briefly for a limited purpose, such as to use the restroom.
    • Non-NYC resident performing artists, college or professional athletes, and anyone who accompanies them.
    • People who have requested reasonable accommodations for medical or religious reasons. If a worker is granted a reasonable accommodation, businesses must record the basis for the accommodation and keep supporting documentation in accordance with the below guidance.

Employees who have a sincerely held religious belief (not a social or political belief), or a medical condition that prevents them from being vaccinated may apply for a reasonable accommodation. Employees must apply for a reasonable accommodation by December 27, 2021.

To request a reasonable accommodation due to a sincerely held religious belief (not a social or political belief), or a medical condition, please follow the steps below:

    • Step 1: Fill out the Pacific College Religious or Medical Exemption form.
    • Step 2: Once your exemption form is complete, please submit your request with any supporting documentation directly to Marcy Madix, Vice President of Human Resources, at [email protected].

Pacific College will follow the guidance and checklists provided by the City of New York, Guidance on Accommodations for Workers in evaluating requests from employees for reasonable accommodation or exemptions from the requirement that they be vaccinated

    • Newly hired employees are required to submit the form upon hire.
